Welcome to KlassApp, a cloud-based school management platform operated by GegoSoft Technologies.

Introduction

These Terms of Service govern your use of KlassApp (the "Platform"), including our website, mobile applications, and any related services. By accessing or using the Platform, you agree to be bound by these Terms and all applicable laws and regulations, including the Uganda Data Protection and Privacy Act, 2019, and other relevant Ugandan legislation.

Eligibility

The Platform is intended for educational institutions, teachers, administrators, parents, and students in Uganda and across East Africa. You must be at least 13 years old to register for an account, or have parental consent if you are between 13 and 18 years old. Schools must have legal authority to use educational technology platforms.

School Data Management

Schools using KlassApp must ensure that all student data entered into the system belongs to their institution or is entered with proper parental consent. Schools are responsible for maintaining the accuracy of student records, including but not limited to: academic performance, attendance records, health information, and personal identifiers.

Parental Consent and Data Sharing

By registering for KlassApp, schools confirm they have obtained appropriate parental consent for processing student data. Parents may communicate with teachers through the Platform'\s messaging system, and all communications are subject to these Terms. Schools must maintain records of parental consent for data processing activities.

Data Protection and Security

KlassApp takes data protection seriously and implements industry-standard security measures including:

• End-to-end encryption for data transmission

• Role-based access control limiting data access to authorized personnel only

• Regular automated backups with secure storage

• Compliance with Uganda Data Protection and Privacy Act, 2019

• Regular security audits and vulnerability assessments

We never sell your data to third parties for marketing purposes. Student data is processed solely for educational purposes and is not used for targeted advertising.

Compliance with Ugandan Laws

KlassApp complies with the following Ugandan laws and regulations:

• Uganda Data Protection and Privacy Act, 2019

• Uganda Computer Misuse Act, 2011

• Uganda National Education Policy

• Uganda Revenue Authority regulations for digital services

Data localization: While we use international cloud providers, we comply with Ugandan data protection requirements for processing personal data of Ugandan residents.

Account Responsibilities

Schools and administrators are responsible for:

• Ensuring data accuracy and updating information promptly

• Complying with all applicable educational regulations

• Maintaining the confidentiality of account credentials

• Notifying KlassApp immediately of any unauthorized access

• Maintaining records required by educational authorities

Acceptable Use

You agree not to use the Platform to:

• Harass, bully, or threaten other users

• Submit false or misleading information

• Attempt to gain unauthorized access to the Platform

• Use the Platform for commercial purposes beyond your subscription

• Extract or scrape data for commercial use

Intellectual Property

All content, features, and functionality on KlassApp, including but not limited to software, text, graphics, logos, and designs, are owned by GegoSoft Technologies or its licensors and protected by Ugandan and international copyright laws. The Platform is licensed, not sold, to users under the terms of their subscription.

Third-Party Services

KlassApp may integrate with third-party services such as WhatsApp, Google, and payment processors. Your use of these services is subject to their respective terms of service. We are not responsible for the actions or content of these third parties.

Payments and Subscriptions

Payments for premium features are processed securely through third-party payment processors. All fees are quoted in USD. Schools are responsible for maintaining valid payment information. No refunds are provided for partial periods, but unused time will be credited if the account is terminated for cause.

Term and Termination

These Terms remain in effect until terminated. Either party may terminate the agreement with 30 days written notice. GegoSoft Technologies may terminate or suspend your account immediately for violation of these Terms or applicable law. Upon termination, all data access rights are revoked.

Dispute Resolution

Any disputes arising from these Terms shall be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to mediation in Kampala, Uganda. If mediation fails, disputes shall be submitted to the courts of Kampala, Uganda.

Governing Law

These Terms are governed by and construed in accordance with the laws of Uganda, without regard to its conflict of law principles.

Limitation of Liability

To the maximum extent permitted by law, GegoSoft Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or business opportunity, even if advised of the possibility thereof.

Indemnification

You agree to indemnify and hold harmless GegoSoft Technologies, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, losses, damages, liabilities, costs, and expenses arising from your use of the Platform or violation of these Terms.

Changes to Terms

We may revise these Terms at any time. Changes will be effective upon posting to the Platform. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
